A MULTIFAMILY RESIDENTIAL COMMUNITY

The Project

The Coachella Valley BTR (Build-to-Rent) Project, also known as
Summerwell La Quinta and Vista Monroe Homes, will consist of the
development and construction of an approximately 240 home community
consisting of single-family homes intended for the build-to-rent residential
market. The community is located on a 40-acre site at 55150 Monroe
Street, Thermal, California – adjacent to the cities of La Quinta and Indio,
CA in unincorporated Riverside County, California. The area, also known as
the Coachella Valley, is part of the greater Palm Springs metropolitan area.

Upon completion, the Project will feature 240 newly-constructed homes
for rent on eighty (80), 10,000 square foot lots.

EB-5 funds will be utilized in all aspects of the development and
construction activities of the Project. This may include, but is not limited
to, site demolition and abatement, onsite and offsite development,
grading, landscaping, drainage systems, horizontal infrastructure, and
vertical construction of the Project.

    The Dallas project represents the 63rd CMB EB-5 partnership with investor I-829 petitions approved by USCIS

    DALLAS, January 2, 2024 – CMB Regional Centers (CMB), one of the most experienced regional center operators in the EB-5 industry, today announced the first approval of petition I-829 for an investor in its Group 66 – Hôtel Swexan project. Approval of the I-829 petition is the final step in the EB-5 visa process for immigrant investors to be issued a permanent green card (conditions removed) and achieve permanent residency in the United States.

    The USCIS has approved over 5,500 I-526 petitions for conditional green cards and nearly 3,000 I-829 petitions for permanent green cards in connection with CMB partnerships.* In its more than 25 years of experience in the EB-5 industry, CMB has repaid over $1.3 billion USD to its investors.

    Battineni v. Mayorkas, Klasko Case Clarifies “Path of Funds” for EB-5 Investors

    Ron Klasko, a trusted EB-5 attorney with a wealth of litigation experience, recently achieved a monumental victory in an immigration case, Battineni v. Mayorkas, Civil Action 22-1332 (PLF) (D.D.C. Oct. 2, 2024) with implications for prospective investors in the EB-5 program. 

    A groundbreaking decision out of Washington, D.C., the outcome represents the first federal court decision rejecting a long-standing interpretation of the United States Citizenship and Immigration Services’ (USCIS) “path of funds” requirement for EB-5 Immigrant-Investors.

    The decision effectively rejected the USCIS policy and determined the only relevant issue is the lawfulness of the immediate source of the funds used for the investment, further advising that there is no regulatory requirement to trace the funds “back to persons or entities who provided the funds.” So long as the immediate source of funds is lawful, there is no need to trace it back to the person or entity who provided the funds to the immediate source.

    Brandon Meyer, founder and Managing Partner of Meyer Law Group, noted the importance of the decision for EB-5 Investors:

    ‘This decision, while not binding on USCIS, has already been used by our office to successfully overturn prior I-526 denials.’

    We encourage each of our investors to work with well-qualified immigration counsel on source-of-funds documentation, given the unique situations of each individual investors and their investments. That said, the outcome of this case promises to pave the way toward a streamlined, less cumbersome path forward for immigrant investors around the world.

    The petition was approved by USCIS following CMB filing a writ of mandamus

    DALLAS, October 9, 2024 – CMB Regional Centers (CMB), one of the most experienced regional center operators in the EB-5 industry, today announced that its Group 84 – Hillwood Daytona project has received Form I-956F approval from the United States Citizenship and Immigration Services (USCIS)

    The approval comes in response to CMB requesting a writ of mandamus, which sought an order from the court to require the USCIS to adjudicate the I-956F petition. An integral part of the USCIS approval process, an I-956F approval confirms that the project meets all necessary EB-5 Immigrant-Investor Program requirements.

    “It is extremely rewarding to see that our efforts to ensure adjudication of the Group 84 project have paid off,” said Noreen Hogan, President at CMB. “We’re proud to have secured a successful outcome for our investors, who are one major step closer to achieving permanent residency in the United States.”

    The I-956F petition was filed with the USCIS in January 2023 and, when it became apparent the CMB Group 84 petition adjudication was taking longer than expected, CMB worked, on behalf of its investors, to request the writ of mandamus. 

    The CMB Group 84 EB-5 partnership lent $79.2 million to a Hillwood Development Company-affiliated entity for the construction of a Daytona Beach, Florida build-to-suit logistics facility for a Fortune 500 tenant. With over 40 EB-5 projects and more than $500 million in EB-5 loan repayment to investors, CMB and Hillwood Development Company have cultivated one of the most successful lender-borrower relationship in the EB-5 industry.
